FTB Offer in Compromise Applications & Financial Records

Individual taxpayers generally apply through the Offer in Compromise Booklet and Application for Individuals, Form FTB 4905PIT. Those who owe tax debt to more than one participating state agency may instead use the Multi-Agency Application, DE 999CA.

An individual application may require records such as:

  • Income verification and documentation of necessary expenses
  • Bank and investment account statements
  • Housing records and information about other assets
  • Applicable legal or medical documentation

When a representative submits or handles an offer, the FTB requires a Power of Attorney authorizing that representation. We help clients organize the requested financial records and present figures consistently throughout the application.

Documentation for Business Applicants

Business entities must include required returns through the current year. They must also provide statements for every bank account or proof that an account has been closed. A business that has ceased operating must submit a final return marked as final.

FTB Review, Offer Payment & Continuing Obligations

The FTB generally issues a decision within 4 to 6 months after assigning an account for review, although a complex account can take longer. Timing may depend on the completeness of the submission, the financial issues involved, and any requests for additional records.

Applicants shouldn’t send the offered funds with the initial application. If the agency requests payment, it does so by letter. The offer amount must then be paid as a lump sum because installment payments toward an accepted offer aren’t available.

Accepted payment methods for a requested offer payment include:

  • Cashier’s check
  • Money order
  • WebPay

The FTB may require a collateral agreement as a condition of acceptance. This agreement directs a percentage of future income above an established threshold to the state. Its terms and duration depend on the agreement issued in the particular case.

Collection status and applicable deadlines require case-specific review while an offer is pending. We examine each taxpayer’s notices and circumstances rather than assuming that an application changes active collection measures.
