Chapter 13 Bankruptcy Compared With Chapter 7
Chapter 13 uses future income to fund a repayment plan that generally lasts three or five years. Chapter 7 follows a liquidation process in which nonexempt property may be sold to pay creditors, although exemptions can protect qualifying assets.

How a Chapter 13 Repayment Plan Works

Filing therefore doesn’t mean that foreclosure, repossession, garnishment, or another action will remain stopped.
Important parts of a Chapter 13 case include:
- Plan duration: Repayment generally continues for three or five years, depending on income and other legal requirements.
- Trustee payments: The filer pays a Chapter 13 trustee, who distributes funds to creditors according to the confirmed plan.
- Debt treatment: Payment amounts depend on income, reasonable expenses, assets, debt classifications, and Bankruptcy Code requirements.
- Bankruptcy discharge: After required payments and other obligations are completed, the court may discharge eligible remaining debts. Certain debts remain nondischargeable.
