Bank Account Levies & Wage Levies: How Each Works

IRS levies primarily reach two things: funds in your bank account and your ongoing wages. Each works differently, and so does the timeline for responding. In limited situations, the IRS can also reach other assets such as vehicles or business equipment.

Bank Account Levy

When the IRS levies a bank account, the bank freezes the funds on deposit and holds them for 21 days before sending them to the IRS. That clock starts when the bank receives the levy notice, not when you find out about it. The 21-day holding period is the practical window for negotiating a release because once those funds are sent to the IRS, recovering them becomes far more difficult.

Wage Levy (Garnishment)

A wage levy under IRC 6331(e) is continuous. It attaches to every paycheck until the levy is released, the debt is paid in full, or the collection period ends. The IRS leaves a small exempt amount based on your filing status and number of dependents; everything above that amount goes to the IRS each pay period.

Common paths to release a wage levy include an accepted installment agreement, Currently Not Collectible status, an Offer in Compromise, or a CDP appeal filed within 30 days of the Final Notice of Intent to Levy. The sooner a formal resolution is in place, the sooner your full paycheck may be restored.
